M’sian Woman Loses Job For Taking MC For Period Cramps, Gets Awarded RM180K By Court

She was accused of faking her illness.
There are days where one would be feeling a bit under the weather, thus rendering them unable to work and having to apply for medical leave.

A woman in Malaysia reportedly was fired by her employer after the latter accused her of faking her period cramps, prompting her to file a lawsuit which she eventually won.

According to a Xiaohongshu (XHS) post shared by a lawyer named Lin Wei Lie (transliteration), the woman was experiencing excruciating pain caused by period cramps and took several days of MC.

However, she was later fired by her employer who accused her of lying about her condition in order to skip work.

Unhappy with her unjust dismissal, the woman filed a lawsuit against her employer with the Industrial Court of Malaysia.

Thankfully, they ruled in her favour, saying that her MC was authentic and valid. They also ordered her employer to pay RM180,000 in compensation.

No grounds for firing if MC is valid

In the post, Lin said that employers do not have the right to fire employees who apply for MC when they’re truly ill.

He added the only time they’re able to do so is when workers are found to have abused their sick leave such as forging MCs or taking sick leave to go on a holiday.

Under Section 471 of the Penal Code, those found guilty face a jail sentence of up to seven years, a fine, or both.
