We’ve all heard stories of people falling victim to scams or fraudulent activities. Sometimes, it’s hard to imagine how someone could deceive others for personal gain.
In a recent case, a single mother found herself facing the consequences of profiting from a fraudulent birthday party booking service.
Siti Helena Azmi, a 32-year-old woman, pleaded guilty to the charges brought against her and was fined RM2,000 by Magistrate Mohamed Redza Azhar Reza.
According to Kosmo, the incident occurred on August 30 of the previous year at around 1:40 pm in the outpatient section of a private medical centre in Subang.
Helena allegedly deceived a 42-year-old woman into entrusting her with RM1,500 for a birthday party booking service that she never intended to deliver.
Legal proceedings and imposed fine
Section 417 of the Penal Code stipulates that such offenses carry a potential punishment of up to five years of imprisonment, a fine, or both.
In this case, the court decided to impose a fine, with a three-month prison term as an alternative consequence if the fine was not paid.
Ultimately, Helena managed to pay the fine and avoid imprisonment.
During the proceedings, Helena was represented by Lawyer Ainul Farihah Azizi, who pleaded for a lenient punishment, considering her client’s status as a single mother responsible for supporting a six-year-old child.
On the other hand, Deputy Public Prosecutor Erneetha Kaur Baghwant Singh argued for a proportional penalty, taking into account the public interest and the prevalence of similar fraud cases.
