A tuition teacher in Sabah will spend the rest of his life in jail after the court sentenced him to 105 years’ jail and 70 strokes of the cane for raping his eldest daughter between December last year and March 19.
Judge Ahmad Faizadh Yahaya ordered the accused to serve 15 years’ imprisonment and receive 10 strokes of the cane for each charge after the accused pleaded guilty to seven separate charges under Section 376(3) of the Penal Code yesterday (July 21).
During mitigation, the prosecution called for maximum penalties, arguing that incestuous rape was one of the most severe sexual offences.
They added the breach of trust between a father and daughter was a major aggravating factor, stating the accused betrayed his duty to protect his daughter, who was 16 at the time, to gratify his lust.
Begged for forgiveness
The accused told the court he was “ashamed and terrified” by his actions and said he fully accepted the punishment handed to him.
I am truly repentant and deeply regretful. I hope I am the last person to commit such an act, and I hope to be given a chance, if released later, to meet my children and family to ask for their forgiveness.”
Previous conviction
In a separate case which concluded in April, the accused was handed a 165-year jail term and 110 cane strokes by the Lahad Datu Sessions Court after he pleaded guilty to 11 rape charges involving his two daughters, who are now aged 22 and 25.
He was ordered to serve 15 years’ imprisonment for each charge consecutively, which were also framed under the same provision, reported Sinar Harian.
Combined with the recent ruling, the accused will spend a total of 280 years in jail and caned 180 times.
However, the total number of strokes imposed is capped at 24 in accordance with Section 288(1) of the Criminal Procedure Code.
