Court Mandates Atmosphere 360’s Vacate

A recent development involves Menara Kuala Lumpur Sdn Bhd and its owner, Hydroshoppe Sdn Bhd, obtaining a High Court vacate order against Asian Kitchen (M) Sdn Bhd, which operates Atmosphere 360 in KL Tower. According to the court’s directive, Atmosphere 360 must vacate its leased space in KL Tower by January 4th.

Unexpected Closure Shocks CEO

Ringo Kaw, CEO of Asian Kitchen, expressed shock and distress upon receiving the closure notice. On December 21st, High Court bailiffs abruptly enforced a shutdown, even with a full house of customers.

Ringo described this timing as particularly unfortunate, considering the Christmas and New Year festivities and the restaurant’s fully booked status for the upcoming season.

“I feel helpless. Hope the authorities will treat us fairly,” Kaw stated. In response to the situation, Atmosphere 360 has begun issuing refunds to its patrons. Kaw appeals for equitable treatment from the authorities during this challenging period.

Legal Disputes and Promises Unkept

Kaw revealed that the previous management had verbally promised a three-year tenancy extension, a commitment unfulfilled by Hydroshoppe. This breach led to the restaurant being allowed to operate only until year’s end.

Amidst the controversy, Asian Kitchen has taken legal action, underscoring the Malaysian Anti-Corruption Commission’s (MACC) ongoing investigation into Hydroshoppe’s acquisition of KL Tower.

This investigation hinges on allegations against Hydroshoppe director Datuk Abdul Hamid Shaikh Abdul Razak Shaikh for purportedly bribing a former minister to expedite the concession takeover.

Asian Kitchen has also filed a lawsuit against Menara KL and Hydroshoppe, arguing the share and ownership transfer from Telekom Malaysia Bhd to Hydroshoppe as invalid due to possible illegalities connected to Hamid’s corruption charges.

In retaliation, Hydroshoppe requested a summary judgment, asserting that Atmosphere 360’s tenancy agreement expired on June 30.

The court ruled in favor of Menara KL and Hydroshoppe, precipitating the immediate cessation of Atmosphere 360’s operations.

This decision has caused significant disruption for the restaurant, especially during the holiday season.
