32yo M’sian Man Allegedly Rapes Woman With Learning Disabilities, Pleads Not Guilty

He also allegedly forced the victim to perform oral sex on him.
Disabled individuals are considered to be one of the most vulnerable people in society as they often have to rely on the kindness of others to get about their day.

Unfortunately for one woman, she found herself becoming the victim of sexual assault at the hands of a man who pretended to offer help.

32yo M’sian man allegedly rapes woman with learning disabilities

According to Harian Metro, the accused was 32-year-old Shamsuddin Ahmad, who was slapped with two charges of rape and performing oral sex on the victim in Muar, Johor last June.

China Press reported that the 30-year-old victim had learning disabilities.

For the first charge, Shamsuddin was accused of raping the victim at his rented house between 12pm and 1pm on June 13. As for the second charge, he was accused of forcing the victim to perform oral sex on him at the same place and time.

He faces a maximum jail term of up to 30 years and caning under Section 376(2) of the Penal Code for the first charge, and a maximum jail term of up to 20 years and caning under Section 377C of the same act for the second charge.

However, Shamsuddin pleaded not guilty to both charges when it was read out before Judge Irwan Suainbon.

Pretended to offer victim help

According to the facts of the case, Shamsuddin had offered to tow the victim’s car following a car accident and invited her to his house to examine her injuries. However, it was proven to be a trap as he allegedly proceeded to rape and sexually assault her.

He also allegedly threatened the victim not to tell anyone about what had happened.

The victim later lodged a police report on Sept 21, leading to Shamsuddin’s arrest the next day, reported China Press.

The prosecution, which was led by Deputy Public Prosecutor Nur Sulehan Abd Rahman, requested the court to impose bail of RM30,000 for each charge.

The court then set bail at RM20,000 for both charges with one surety and ordered Shamsuddin to report to the Muar district police headquarters (IPD). He was also barred from harassing the victim or approaching trial witnesses.

Case mention has been set for October 30.
