A foreign man escaped the gallows but ultimately lost his freedom and caned seven times after he was found guilty of possessing and planting a cannabis tree at his home in Sabah.

NST reported that the accused, 28-year-old Nicklen Jaccqres, was convicted of the crime after Judge Elsie Primus found that the prosecution had successful proven the case beyond reasonable doubt.
Nicklen was charged with having and planting a cannabis tree measuring 44.7cm tall and weighing 6.38g inside the room of a house located in Kg Bahang, Jalan Hungab, Penampang, on August 19, 2020 at 2.40pm.
The charge was framed under Section 6B(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 6B(3) of the same Act, which carries a life imprisonment, and whipping not less than six strokes if convicted.
A total of six witnesses were summoned by the prosecution while Nicklen was the only witness for the defence.
Nicklen was ordered by the court to begin serving his sentence from the date of his arrest on August 19, 2020 and was represented by PJ Perira while deputy public prosecutor Tham Pou Jin lead the prosecution.
