Penang Cemetery Duo’s Lawyer Says 1-Year Jail Sentence ‘Too Excessive’

A lawyer representing the couple involved in the Penang cemetery case has spoken out, saying the jail sentence handed down by the Magistrate Court was “too excessive”.

The update comes after the defence moved to file a revision application at the High Court to review the decision.

Lawyer argues act was not in public view

Speaking exclusively to WeirdKaya, Datuk Naran shared that he personally disagrees with the severity of the sentence.

According to him, the circumstances of the case did not warrant such a harsh punishment.

It was too excessive because the act was done at a private property and not in public view. The act was also done, if at all, between two consenting adults.”

He emphasised that the context of the incident should be taken into account when determining the appropriate sentence.

Says couple faced great injustice

Datuk Naran also said he believes a great injustice has been done towards the couple following the ruling.

As a result, he has taken on the case on a pro bono basis, meaning he is representing them without charging any legal fees.

The move to file a revision aims to have the High Court reassess both the conviction and the sentence imposed.

Case now pending High Court review

With the revision application now filed, the case will be reviewed by the High Court, which has the authority to uphold, reduce, or overturn the sentence.

Further developments are expected as the court considers whether the punishment was proportionate to the circumstances highlighted by the defence.
