Two men who were filmed assaulting a mamak staff at a Pelita restaurant in Cyberjaya last week were charged at the Sepang magistrates’ court yesterday (Mar 21).
NST reported that the accused were Elanggovan Muniyandi and Vengateswaran Malaisamy, who were both 51-years-old and friends.
They were accused of committing the offenses at Nasi Kandar Pelita Glomac, Cyberjaya, at around 7.30pm last Thursday (Mar 16).
Duo faces multiple charges
Elanggovan and Vengateswaran were charged under Section 323 of the Penal Code for causing hurt, Section 427 for causing mischief by throwing plates belonging to the restaurant, and Section 509 for uttering obscenities at the employees.
However, Elanggovan was slapped with an additional charge under Section 324 of the Penal Code for causing voluntary hurt with a pair of tongs, reported FMT.
Under this Section, he’s liable to a jail term of up to 10 years, a fine, or caning if convicted.
As for the punishment under Section 427 and Section 509 which both Elanggovan and Vengateswaran face, it carries a maximum jail term of five years, a fine, or both upon conviction.
They also face a year in jail, a RM2,000 fine or both upon conviction under Section 323 of the Penal Code.
Pleaded not guilty
When the charges were read out before Magistrate Ayuni Izzaty Sulaiman, both men pleaded not guilty.
Their lawyer, Lingeswaran Andiappan, asked for a lower bail amount, saying that Vengasteswaran earns a meagre RM800-RM900 a month as a taxi driver while Elanggovan earns RM2,000 a month for his family of three kids.
Bail was later set at RM8,600 for Vengasteswaran and RM11,600 for Elanggovan.
Netizens were shocked by the viral clip of the fight, where it showed the duo getting into an intense brawl with a mamak worker who told them not to pick food with their hands.
