M’sian Civil Servant Jailed 30 Years & Fined RM852,000 For Power Abuse

The fines for the 30 charges ranged from RM10,000 to RM62,000.

A civil servant, Mohd Syamsul Jikan, has been sentenced to 30 years in prison and fined RM852,000 for 30 power abuse charges by the Sessions Court.

According to NST, Judge Jason Juga imposed the sentences after finding Syamsul guilty on all counts.

Jail terms to run concurrently

Syamsul faces an additional three to six months in jail for each fine he fails to pay. He received one-year jail terms for each count, which will run concurrently.

The court has allowed a stay of the jail sentence and fines pending Syamsul’s appeal to the High Court.

He is currently out on bail.

What happened?

The Borneo Post reported that this ruling follows a 10 July 2023 decision by the Court of Appeal, which ordered Syamsul to defend the charges after the prosecution successfully appealed against his earlier acquittal by the High Court on 6 December 2021.

The High Court had dismissed the prosecution’s appeal and upheld the Sessions Court’s 30 September 2019 ruling, which freed Syamsul without requiring him to present a defense.

Syamsul, a Grade S22 officer, was accused of using his company to supply goods to the Cure and Care Rehabilitation Center (CCRC) in Papar.

The charges state that he supplied office stationery, clothes, cooking gas, and tent rental services to CCRC through Syarikat Emmy Stationery, a company allegedly owned by him.

The offenses took place at the CCRC office between January and October 2015.

Syamsul was charged under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which carries a maximum penalty of 20 years in prison and a fine of at least five times the amount involved or RM10,000, whichever is higher.
