Fine & jail time for men caught wooing married women in Terengganu
In a bid to curb this issue, the Syariah Court in Terengganu has recently ruled that any man who is caught trying to seduce a married woman will be liable to a fine or RM5,000, jailed for 3 years, or both, reported NST.
According to State Syariah chief judge Datuk Wan Mohd Zakri Wan Mohd, he said this is punishable under Section 43 of the Terengganu Syariah Criminal Offences Enactment 2001.
The Syariah Court can also order the wife to return to her husband. The man and the woman (involved in the affair) are considered to have committed a sin as the wife belongs to the husband.

“While some argue that the wife is not the property of the husband, in Syariah, the wife is considered the husband’s possession, and the husband is responsible for her from A to Z,” he said.
Mohd Zakri added that while the act of men wooing married women have not resulted in any prosecutions, but it has contributed to the divorce rate in Terengganu.
On Dec 15, the Federal Court ruled that Section 498 of the Penal Code that criminalises a man for enticing a married woman was unconstitutional.
The ruling was made by Chief Justice Tun Tengku Maimun Tuan Mat, who said Section 498 was discriminatory based on gender, which comes in opposition with Article 8(2) of the Federal Constitution.
