40yo M’sian Fined RM4K For Threatening To Hurt Man With Fork And Knife

He allegedly told the victim "I want to chop off your hand and gouge out your eyes".
While losing our cool is something normal and happens every once a while, it’s never okay to lash it out on someone else by threatening to cause bodily harm.

A man in Johor learnt this at the cost of his wallet after he pleaded guilty in court for threatening to grievously hurt another man with utensils, specifically a fork and knife.

According to NST, the accused, 40-year-old plant nursery worker Tan Hock Meng, pleaded guilty to three counts of causing hurt and criminal intimidation last month.

Two of them were framed under Section 323 of the Penal Code for voluntarily causing hurt and one under Section 506 of the same Act for criminal intimidation.

He made the plea immediately after the charges were read out before magistrate Fatin Dalilah Khalid by the court interpreter.

Based on the first two charges, Tan had caused hurt to 58-year-old Gan Kee Chai on Sept 26 and 27 at 2.30pm at Taman Cempaka Selatan in Muar, Johor.

This makes him liable to a year’s jail, a RM2,000 fine, or both for each count under Section 323. However, he was given a fine of RM900 for each charge in default of two months’ jail.

As for the third charge, Tan was accused of threatening Gan with a fork and knife while saying “I want to chop off your hand and gouge out your eyes”.

For this charge under Under Section 506, he faces up to seven years in jail, a fine, or both. Instead, Fatin Dalilah fined him RM2,500 in default of seven months’ jail.

In total, he was fined RM4,300 for all three charges.

Before the sentence was passed, prosecuting officer Assistant Superintendent Mohammad Zuwairi Md Noor asked the court to impose the full sentence granted by the law as the alleged crimes were serious.

Tan’s lawyer, Nor Hafizah Abdullah from the National Legal Aid Foundation, pleaded for leniency, saying that Tan needed to care for his two children and elderly parents.
