A 19-year-old private university student who was caught allegedly taking an upskirt video of a woman at an MRT station in Cheras was charged in court today.
According to NST, the suspect, Muhammad Hafiz Damian Abdul Qawwiy, was accused of outraging the woman’s modesty by filming her in secret.
Pleaded not guilty to charge
According to the charge sheet, Hafiz committed the offense at 8.53pm on Sunday (June 22) at the Taman Pertama MRT station.

The charge was framed under Section 509 of the Penal Code for intending to insult the modesty of a woman, which provides for a maximum five-year jail term, a fine, or both upon conviction.
When the charge was read out before Magistrate Atiqah Mohamed @ Mohamad Saim, Hafiz said, “I understand the charge. I plead not guilty.”
Granted bail
In mitigation, Mohammad Sufi Mohammad Sukor from the National Legal Aid Foundation, who represented Hafiz, appealed for bail, saying his client was a first-time offender and had fully cooperated with police.

I ask that he be granted bail as he is about to sit for an examination. This is his first offence, and he has cooperated with police. There is no risk of him absconding.
“His foster father is present in court to post bail, but only has less than RM1,000,” he added.
Atiqah then asked Hafiz’s foster father, who was seated in the gallery, whether he had the money, to which the latter replied he had RM1,000 with him.
When asked when his examination will take place, Hafiz said his final paper will be on Thursday.

The court then allowed bail at RM1,000 with one surety and ordered Hafiz to report to the police station every month until the case is concluded.
The court also fixed Aug 18 for mention and the appointment of counsel.
