“Resign In 2 Hours Or Else” — M’sian Worker Allegedly Released Early During Final Month Of Probation

Her employment was allegedly cut short even though her probation was set to end in March.
A Malaysian woman has taken to social media to vent her frustration after claiming her friend was allegedly forced to resign by an electrical engineering company in Petaling Jaya.

According to her post, her friend was suddenly called in by HR after nearly four months of probation and was told to either resign voluntarily or face termination.

“Not medically fit” but only after 4 months?

The OP claimed that HR cited her friend as “not medically fit” as the reason.

However, she questioned why this was only raised near the end of probation.

Why only after four months? Why not from the beginning?” she wrote.

When her friend refused to submit a resignation letter, HR allegedly called again the next day and gave a two-hour ultimatum to decide. If not, the company would issue a termination letter.

Her friend then requested a written reason for the forced resignation. According to the OP, HR said there was none and proceeded with termination instead.

From termination to non-confirmation — ended on the same day

On the third day, the company allegedly issued a non-confirmation letter instead of a termination letter and ended employment immediately.

Despite the employment contract stating a 10 working day notice period, the OP claimed her friend’s probation was due to end on 5 March, but the company set an early release date of 13 February.

“It’s really cruel,” she wrote.

The OP also alleged that HR instructed her friend not to communicate via WhatsApp and to call directly instead.

She further claimed her friend was asked to perform tasks outside of job scope, including setting up rat traps.

Colour blind issue raised late

In response to netizens’ questions, the OP later revealed that the company allegedly claimed her friend was colour blind.

However, she said the condition was detected during a pre-employment medical check-up conducted at a panel clinic.

She questioned why the issue was not addressed in the first month if it was truly a concern.

According to her, the employment letter did not specifically mention colour blindness as a disqualifying factor. She also claimed that other colleagues in the same position were colour blind without issue.

When asked why the matter was only brought up at the fourth month, she alleged HR said it was to “give you experience working here.”

“Don’t resign. Take the termination letter”

The post quickly gained traction, with many Malaysians sharing advice and similar experiences.

Some questioned whether there was any notice period given.

Others advised her friend not to resign voluntarily.

“Take the termination letter. If they terminate, they must have cause,” one user wrote.

Another commented:

“Forced resignation is wrong. Keep all evidence including screenshots and recordings.”

Several netizens advised lodging a report with the Jabatan Perhubungan Perusahaan (JPP) within 30 days of receiving the non-confirmation letter, and to gather all communication records as proof.

Others pointed out that during probation, termination typically requires documented misconduct or clear performance issues with evidence of coaching and improvement plans.

Constructive dismissal?

One user noted that suggesting resignation at the employer’s request may amount to forced resignation, which could potentially fall under constructive dismissal.

They advised filing a complaint through the official portal under the Ministry of Human Resources.

At the time of writing, the OP did not disclose the name of the company, only hinting that it is based in Petaling Jaya and operates in the electrical engineering sector.

The allegations remain one-sided and unverified.
