Only 5 Types Of Officers Can Legally Check Your MyKad, Security Guards Aren’t One Of Them

Scanning or holding your MyKad without authorisation may violate data protection laws.
Ever walked into a condo, office, or event space and been asked by a security guard to hand over your IC, or even had it scanned with a machine you’ve never seen before?

Well, here’s something a lot of Malaysians might not know: they’re not actually allowed to do that.

The National Registration Department (NRD) recently reminded the public that security guards are not legally permitted to request, hold, or scan your MyKad. This is not just a guideline; it is clearly stated under the law.

So, while it might seem like a routine part of entering buildings, it is actually something that goes against the National Registration Regulations 1990.

Then who can check your IC?

Let’s clear this up. Under Regulation 7(1) of the National Registration Regulations, only five types of officers are allowed to inspect or handle your IC:

  1. NRD officers
  2. Police officers
  3. Customs officers
  4. On-duty military personnel
  5. Public officers authorised by the NRD Director-General

Unless the person asking fits into one of these categories, they have no legal right to see or hold your MyKad. That includes security guards, even if they are just following instructions.

What about scanning it?

That is another serious issue. NRD clarified that scanning a MyKad using electronic devices is also not allowed. This falls under the Personal Data Protection Act 2010 (PDPA), as reported by The Vibes.

In short, this law protects your personal information. It states that private companies cannot simply collect, scan, or store your data without proper consent and security measures.

So when someone scans your IC without any explanation or legal basis, it may count as a data breach.

What triggered the reminder?

This entire issue resurfaced after a viral social media post showed a security guard at a commercial building using a scanner on a visitor’s MyKad.

The post sparked confusion and concern, with many asking whether such actions were even legal.

That is when NRD stepped in to set the record straight.

What should you do if it happens?

If a guard tries to:

  • Hold your IC
  • Take a photo or scan it
  • Refuse entry unless you hand it over

You can calmly refuse. You are within your rights to say no. You can also report the incident to the NRD or the Department of Personal Data Protection (JPDP).

Security matters. But there is a difference between access control and violating someone’s privacy.

The MyKad contains highly sensitive information, such as your full name, IC number, address, and even biometric data. It should not be casually handed over or scanned without reason.
