M’sian Woman Gets RM7mil Compensation For Arm Which Was Crushed By Lorry 10 Years Ago

Her lawyers argued the accident had left her unable to lead a normal life.
A woman recently won RM7.1 million in compensation after she successfully won a lawsuit she filed against a motorcyclist’s insurer over a crushed arm she suffered a decade ago.

As a result of the accident, the woman named M Saranya sustained a “brachial plexus injury”, where she is no longer able to use her left arm and is fully dependent on her mother R Naga Chittra for her daily needs, reported FMT.

The accident occurred back on Aug 5, 2014, where Saranya, who was 12 years old at the time, was riding pillion with her father, N Mahendran, who had picked her from school.

Along the way, a motorcycle crashed into them from behind at Persiaran Hamzah Alang, in Kapar, Klang, leading to the demise of its driver, Shazrin Hassan.

As for Mahendran and Saranya, both of them were thrown off their motorcycle due to the crash’s impact and landed on the road. Unfortunately, a lorry was coming towards their direction at the time and ran over both of them.

Mahendran died at the scene while Saranya’s left arm got crushed and she also sustained head injuries.

In 2018, Saranya, through her mother, filed a lawsuit against the lorry driver and Shazrin’s estate. She was later paid an undisclosed sum by the lorry’s driver’s insurer in a consent judgment.

In court, Saranya’s lawyers GK Ganesan and RS Kameswary argued that she was no longer able to do simple tasks with both hands.

They also claimed that her chance of living a normal life was robbed by the accident and that it has left her deeply traumitised to the point where she’s scared to travel in a car.

In addition, they said a prosthetic device named MyoPro 2 could assist Saranya lead an “almost normal and independent life”.

Judge Zarifah Zainal Abidin eventually ruled in Saranya’s favour and awarded RM6.9 million for the purchase, periodic replacement and maintenance of the MyoPro 2 device as well as RM215,000 for pain and suffering.
