A 65-year-old man who was accused of physically assaulting a non-Muslim teen for not fasting at a convenience store in Johor has claimed trial to the charge.
The accused, Abdul Razak Ismail, made the plea when the amended charge was read before magistrate A. Shaarmini at the Johor Bahru Magistrates Court today, reported NST.

According to the charge sheet, Abdul was accused of causing voluntary hurt to 21-year-old Elijah Ling Zhao Zhong, 21, on the first floor of a shopping mall in Tampoi at around 6.15pm last Sunday (Mar 17).

The charge, which was framed under Section 323 of the Penal Code, carries a maximum sentence of one year in prison, a fine of up to RM2,000, or both upon conviction.
Deputy public prosecutors Nor Afiqah Musa and Nur Fatihah Mohd Nizam asked for a RM8,000 bail to be posted, but Abdul’s counsel Mohd Salleh Togimin argued that it was too harsh, adding Abdul was a pensioner with three kids, one of whom is still in university.
Bail was eventually set at RM2,000 with one surety and the case will be re-mentioned on Apr 19 for document submission.

Earlier this morning, Abdul was charged in court but was granted a discharge not amounting to acquittal (DNAA) due to a technical issue in the initial charge brought against him.
After the issue was resolved, the Attorney-General Chambers (AGC) issued a statement saying he would be charged again in court.
