Back in March, a couple caused a huge uproar following a clip of them having intercourse in broad daylight at a cemetery in Ayer Itam, Penang.
Not long after their arrest, the duo pleaded guilty to an act of gross indecency under Section 377D of the Penal Code and were sentenced to a year in jail each.
However, their lawyer has since filed a revision against the jail sentence as he believed it was too harsh.
‘All I hope for is justice’
Speaking to NST, the duo’s lawyer, Datuk Naran Singh, said he initially filed an appeal for the High Court to review the sentence imposed, as well as determine whether it was manifestly excessive in the circumstances of the case.
He then followed it up by filing a revision to expedite the hearing before a judge as quickly as possible.
“I’ve since received a date from the High Court to hear the revision for both the conviction and sentence, which will be on April 21.
The appeal is still pending as it usually takes time. All I can hope for is for justice to prevail for the couple.
“I’m also looking forward to the court in deciding whether the sentence was too excessive and whether there was a miscarriage of justice.”
The duo, M. Jegathesan and Halila Abu Bakar, were jailed after they were convicted of committing an act of gross indecency at a Chinese cemetery in Batu Gantung, Ayer Itam, at 8.30am on March 22.
Under Section 377D of the Penal Code, any acts of “gross indecency” between persons, be it in public or private, carries a jail term of up to two years upon conviction.
