15yo Suspect In Bandar Utama School Tragedy Remains Charged With Murder As Case Moves To High Court

Accused currently held at Puncak Alam Correctional Centre.
The murder case involving a teenage boy charged with killing a 16-year-old girl at a secondary school in Bandar Utama, Selangor, has been transferred to the Shah Alam High Court, where it will proceed to full trial.

According to The Star, the accused, who is now 15 years old, remains charged with murder under Section 302 of the Penal Code in connection with the incident that occurred on Oct 14 last year at SMK Bandar Utama Damansara 4 in Petaling Jaya.

The transfer was ordered on Friday, Jan 30, by Magistrate Amira Sariaty Zainal after the prosecution obtained approval from the Attorney General’s Chambers under Section 177A of the Criminal Procedure Code.

Defence confirms case ready for full trial

The accused is represented by lawyer Kitson Foong, who confirmed that the case will now move into the trial stage at the High Court.

The current charge is under Section 302 of the Penal Code for murder, and the prosecution has assessed that the evidence is sufficient for the charge to proceed,” Foong told the media after the closed-door proceedings.

He added that the defence respects the court’s decision and will prepare for a full trial once the High Court sets a case management date and assigns a presiding judge.

Earlier this month, the Magistrate’s Court was informed that a psychiatric evaluation conducted at Hospital Bahagia Ulu Kinta confirmed that the teenage accused was mentally fit to stand trial, following a three-month assessment period.

Due to the accused being a minor, his identity cannot be disclosed, and he is currently detained at the Puncak Alam Correctional Centre.

During Friday’s proceedings, he was brought into court through an internal passage, with the media barred from entry, while his parents and siblings were present.

Deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin and Aqharie Durranie Aziz appeared for the prosecution.

Charge and applicable penalties

The teenager is charged under Section 302 of the Penal Code, which carries the death penalty or a prison sentence of between 30 and 40 years with up to 12 strokes of the cane upon conviction.

However, under the Child Act 2001, the death penalty cannot be imposed on offenders below 18, and the court may instead order detention for a period determined by the Yang di-Pertuan Agong or relevant state authority.

The case stems from a fatal incident on Oct 14, 2025, at SMK Bandar Utama Damansara 4 in Petaling Jaya, which raised widespread concerns over school safety. The trial will now proceed at the Shah Alam High Court once dates are fixed.
